§ 17 VOB-B Sicherheitsleistung

Hoechstgrenze 10 Prozent der Auftragssumme.
Vermischung mit Vertragserfuellungsbuergschaft und Maengelansprueche-Buergschaft kann transparenzwidrig sein.

§ 4 Abs. 7 VOB-B Maengelbeseitigung wahrend Ausfuehrung

Selbstvornahmeordnung bei Maengeln — wirksam.

§ 8 VOB-B Kuendigung

Aussergewoehnliche Kuendigungsgruende — wirksam.

Wechselwirkung mit §§ 650a ff. BGB

§§ 650a ff. BGB (Bauvertrag) gelten zwingend in B2C-Bauvertraegen.
VOB-B im B2C-Bauvertrag praktisch nicht uebernehmbar.
